<p>In preparation for its second patent trial against Samsung scheduled for Spring 2014, Apple has revealed it will seek to include Samsung's new Galaxy S4 smartphone in a list of 22 products it believes infringe iOS user interface patents. As part of its statement filed with the US District Court in California yesterday Apple said it analyzed the Galaxy S4 after its release, and has "concluded that it is an infringing device and accordingly intends to move for leave to add the Galaxy S4 as an infringing product."</p>

<p>Last year a judge <a href="http://www.theverge.com/2012/6/29/3126934/apple-samsung-judge-bans-galaxy-nexus/in/2900691">granted an injunction on Samsung's Galaxy Nexus</a> as part of a new round of legal battles between Apple and Samsung - a sales ban that was then <a href="http://www.theverge.com/2012/10/11/3488740/appeal-reverses-injunction-samsung-galaxy-nexus-in-the-us">reversed by an appeals court</a> last October. Apple had asked the court to reconsider, but <a href="http://www.reuters.com/article/2013/01/31/us-apple-samsung-idUSBRE90U11220130131"><em>Reuters</em> is now reporting</a> it has has been denied. <a href="https://platform.theverge.com/wp-content/uploads/sites/2/chorus/assets/2100463/113.pdf">In an order today</a>, the US Court of Appeals for the Federal Circuit noted that it was rejecting Apple's request for an <em>en banc</em> review - a reconsideration of the sales ban by all nine judges of the Appeals Court. Six days ago, the price <a href="http://www.theverge.com/2012/6/27/3120987/galaxy-nexus-hspa-unlocked-price-drop-349">dropped to $349</a>. Now, however, the phone is listed as "coming soon" on Google's website. <p>Last Friday Apple was granted a <a href="http://www.theverge.com/2012/6/29/3126934/apple-samsung-judge-bans-galaxy-nexus">preliminary injunction on sales of the Galaxy Nexus in the United States</a>, over alleged patent infringement. Samsung <a href="http://www.theverge.com/2012/7/3/3136023/samsung-request-stay-galaxy-nexus-injunction-denied-Apple">just lost its bid to stay the injunction</a>, but that may not matter: Google and Samsung have a patch readied to address the issue that could be rolling out over the air as soon as tonight.
