Federal appeals court won’t stop the TikTok ban from taking effect on January 19th.

The same three judges who ruled last week that a TikTok divest-or-ban law is Constitutional ruled against the company again today and declined to temporarily pause it from taking effect on January 19th.

In response, TikTok said again that it’s taking the case to the Supreme Court.

Upon considering the motions for a preliminary injunction of the Protecting Americans from Foreign Adversary Controlled Applications Act, Pub. L. No. 118-50, div. H, the response from the Government and the replies from the petitioners, it is ORDERED that the motions be denied. At the request of the parties, this court expedited its consideration of the case “to ensure that there is adequate time before the Act’s prohibitions take effect to request emergency relief from the Supreme Court.”

Starbucks’ mobile ordering system is broken.

Sorry for anyone planning a quick coffee break. The Starbucks apps and website are not taking online orders due to some (presumably not Crowdstrike-related this time) outage.

There’s no word on when it might get fixed, but DownDetector shows reports starting around 11AM ET.

Starbucks Mobile app notice reading “Mobile ordering is currently unavailable. Please visit one of our stores and place your order with a barista.”
    Inconvenient.

Why am I telling a robot to memorize something?

I guess “conversational” input is a feature of Google’s updated Gemini AI agents, but this step of the Project Mariner demo is where they lose me.

Maybe the bot can take some research work off my hands, but now I have to remember three steps of instructions to give it and even ask it to remember what it’s doing twice? How is this easier?

Screenshot from Project Mariner YouTube video, showing instructions to the AI bot that say “Memorize this list of companies. Then find their websites and look up a contact email I can use to reach them. Remember these so I can use them later.”

Microsoft just released a patch for an actively exploited zero-day vulnerability in Windows.

Update your systems ASAP, as Bleeping Computer points out that today’s Patch Tuesday updates include one for a zero-day flaw already exploited by attackers.

CVE-2024-49138 - Microsoft Windows Common Log File System (CLFS) driver contains a heap-based buffer overflow vulnerability that allows a local attacker to escalate privileges.

Crowdstrike researchers discovered the flaw, and neither they nor Microsoft have released more details, but the vulnerability affects Windows 10, 11, and various versions of Windows Server.

SiriusXM is cutting costs again and refocusing on cars over streaming.

Last year, Joseph Inzerillo announced SiriusXM’s new logo (below) and plan to conquer new audiences. Now he’s out, as the company cuts spending on marketing to “high-churn” streaming audiences with plans to cut an additional $200 million in annual costs.

CEO Jennifer Witz announced it’s “doubling down” on automotive customers, using streaming as a companion in the app and in Teslas.

It says “SiriusXM” with a star hollowed out inside the first S.

NYPD found a backpack they believe was worn by the suspect in the Brian Thompson shooting.

Two days after someone shot and killed UnitedHealthcare CEO Brian Thompson in Manhattan, police located the “distinctive” backpack the attacker was wearing. They removed it from Central Park, unopened, using an excavator.

As many people, including Peak Design CEO Pete Dering, noticed, it appears to be the company’s Everyday V1 backpack, as shown in a photo obtained by ABC News.

    It’s still Bandcamp Friday.

Whether it’s during Bandcamp Friday or not, buying music sends more money to musicians than playing a subscription stream. So, it might be worth celebrating this event where Bandcamp waives its cut of the money you spend one last time for 2024 as it continues for the next seven hours or so.

Bandcamp has changed hands twice and had significant layoffs since the pandemic tradition started; we’ll see if it continues in 2025.
